Letter to officials in English

To Their Honors, Jorge Rivera Avila, President of the Supreme Court of Justice of the Republic of Honduras; Luís Alberto Rubí, Attorney General; and other representatives of the Supreme Court and Ministry of Public Prosecution:

We are writing to express our concern regarding two matters that are very important in relation to human rights and the rule of law in Honduras.

The first is a trial to be held against the Asociación para una Sociedad más Justa (ASJ) starting on Wednesday, February 24. We have been informed that two appeals that clearly demonstrate both that the charges against ASJ are baseless and that there are technical problems with the way the charges were filed have been rejected. We have also been informed that there have been many unexplained and illegal delays and other irregularities involved with this case since the complaints were filed in January 2007.

In light of this situation, we urge the members of the Supreme Court to do all within the power available to you, as the highest judicial authority in all Honduras, to ensure that the trial against ASJ is run fairly, in complete accordance to the law, and is not influenced by any other interests or considerations outside the law.

We would also like to express our interest in seeing justice done in regards to the assassination in December 2006 of ASJ lawyer Dionisio Díaz García. We understand that two appeals related to the conviction of the hit-men who committed this murder are currently before the Supreme Court: one, lodged by the prosecution, asking for the sentence to be increased, and another, lodged by the defense, asking for the conviction to be overturned. We also understand that the plotters behind this murder have yet to be brought to justice. In light of this situation, we ask that both the Judicial Branch and the Attorney General's Office do all within their power to achieve the following:

-Ensure that the appeals related to the conviction of the hit-men who murdered Dionisio Diaz and that are currently before the Supreme Court are decided on in complete accordance to the law, the evidence available, and the dictates of justice.

-Ensure that the plotters behind Dionisio's murder are brought to justice.

We would also like to take this opportunity to remind you that ASJ has always sought, not to break down Honduras' government institutions, but rather to help these institutions to work better. To that end, ASJ has helped Honduras' Justice system arrest and convict over 100 violent criminals and deal with scores of domestic violence, child-support, and labor cases; has worked with the Ministry of Labor to carry out inspections and negotations with employers; has worked with the Property Institute to obtain land titles for some 30,000 families; and more. ASJ was among the organizations that advocated most strongly for transparency and honesty in the naming of Honduras' new Supreme Court one year ago, and celebrated your being named as Supreme Court President as evidence that the process was indeed carried out transparently.
