Avila, Presidente de la Corte Suprema de Justicia de la República de
Honduras; Luís Alberto Rubí, Fiscal General de la República; y demás
representantes de la Corte Suprema y del Ministerio Público:
Les escribimos para expresar nuestra preocupación en relación a dos
asuntos de suma importacia para los derechos humanos y el Estado de
Derecho en Honduras: En primer lugar, nos interesa un juicio dirigido
en contra de la Asociación para una Sociedad más Justa (ASJ), el cual
empieza el Miércoles, 24 de Febrero. Nos han informado que tanto una
apelación como un recurso de amparo, los cuales claramente demostraban
que las alegaciones en contra de la ASJ son falsos y que además hay
problemas técnicas con la manera en que fue registrada la demanda, han
sido rechazados. También hemos sido informados que han habido demoras
ilegales y sin explicación además de varias otras irregularidades
relacionadas con este caso desde que fuera interpuesto en enero del
2007.
En vista de lo anterior, a los miembros de la Corte Suprema les
instamos a que hagan todo lo que esté dentro su poder como las
autoridades Judiciales más altas en Honduras para lograr que el juicio
en contra de la ASJ sea llevado a cabo en completo acuerdo con la Ley,
y que no sea influenciado por ningún interés o consideración fuera de
la Ley.
También quisieramos expresar nuestro deseo que se haga justicia en
relación al asesinato en diciembre del 2006 del abogado de la ASJ,
Dionisio Díaz García. Entendemos que actualmente hay dos recursos de
casación ante la Corte Suprema en relación al caso de los sicarios
responsables por este asesinato: un recurso, interpuesto por el
Ministerio Público, que pide alargar la sentencia de los sicarios, y
otro, interpuesto por la defensa, que pide la desestimación de la
decisión del Tribunal de Sentencia de hallarlos culpable a estos
sicarios. Además, entendemos que los autores intelectuales de este
asesinato todavía no han sido llevados ante los tribunales. En vista de
esta situación, pedimos tanto al Poder Judicial como al Ministerio
Público, que hagan todo dentro de su poder para lograr lo siguiente:
-Asegurar que los recursos de Casación relacionados con los sicarios
que mataron a Dionisio, y que actualmente están ante la Corte Suprema,
sean decididas en completo acuerdo con la Ley, la evidencia, y las
demandas de la Justicia.
-Asegurar que los autores intelectuales del asesinato de Dionisio sean
llevados ante los Tribunales. También quisieramos aprovechar de esta
oportunidad para recordarle que la ASJ siempre ha buscado no destruir
las instituciones del Gobierno de Honduras, sino ayudarlas lograr un
mejor funcionamiento. Es con este fin que la ASJ ha ayudado a los
Operadores de Justicia capturar y lograr sentencia firme contra más de
100 criminales violentos y manejar de manera satisfacotria decenas de
casos de violencia doméstica, demandas de alimentos, y demandas
laborales; ha trabajado mancomunademente con la Secretaría de Trabajo
para ejecutar inspecciones y negociaciones; ha trabajado en conjunto
con el Instituto de la Propiedad para obtener títulos de tierra en
dominio pleno para unos 30,000 familias de escasos recursos; entre
otros. La ASJ figuró entre las organizaciones que clamaban por la
transparencia y la honestidad cuando se nombró la nueva Corte Suprema
hace un año, y celebró el nombramiento de los actuales Magistrados como
evidencia de la transparencia de ese proceso.

Letter to officials in English

To Their Honors, Jorge Rivera Avila, President of the Supreme Court of Justice of the Republic of Honduras; Luís Alberto Rubí, Attorney General; and other representatives of the Supreme Court and Ministry of Public Prosecution:

We are writing to express our concern regarding two matters that are very important in relation to human rights and the rule of law in Honduras.

The first is a trial to be held against the Asociación para una Sociedad más Justa (ASJ) starting on Wednesday, February 24. We have been informed that two appeals that clearly demonstrate both that the charges against ASJ are baseless and that there are technical problems with the way the charges were filed have been rejected. We have also been informed that there have been many unexplained and illegal delays and other irregularities involved with this case since the complaints were filed in January 2007.

In light of this situation, we urge the members of the Supreme Court to do all within the power available to you, as the highest judicial authority in all Honduras, to ensure that the trial against ASJ is run fairly, in complete accordance to the law, and is not influenced by any other interests or considerations outside the law.

We would also like to express our interest in seeing justice done in regards to the assassination in December 2006 of ASJ lawyer Dionisio Díaz García. We understand that two appeals related to the conviction of the hit-men who committed this murder are currently before the Supreme Court: one, lodged by the prosecution, asking for the sentence to be increased, and another, lodged by the defense, asking for the conviction to be overturned. We also understand that the plotters behind this murder have yet to be brought to justice. In light of this situation, we ask that both the Judicial Branch and the Attorney General's Office do all within their power to achieve the following:

-Ensure that the appeals related to the conviction of the hit-men who murdered Dionisio Diaz and that are currently before the Supreme Court are decided on in complete accordance to the law, the evidence available, and the dictates of justice.

-Ensure that the plotters behind Dionisio's murder are brought to justice.

We would also like to take this opportunity to remind you that ASJ has always sought, not to break down Honduras' government institutions, but rather to help these institutions to work better. To that end, ASJ has helped Honduras' Justice system arrest and convict over 100 violent criminals and deal with scores of domestic violence, child-support, and labor cases; has worked with the Ministry of Labor to carry out inspections and negotations with employers; has worked with the Property Institute to obtain land titles for some 30,000 families; and more. ASJ was among the organizations that advocated most strongly for transparency and honesty in the naming of Honduras' new Supreme Court one year ago, and celebrated your being named as Supreme Court President as evidence that the process was indeed carried out transparently.
